Zaldonado & American Airlines v. Orange County Fire Authority OCSC – Case No. 03CC15008. Related Case No. 04CC08113. American Airlines (“AA”) and a passenger brought separate actions against the Orange County Fire Authority (“OCFA”) after an OCFA fire truck struck a loaded, moving AA airplane on a taxiway at John Wayne Airport. AA claimed over 1 million dollars in property and loss of use damages. OCFA’s Demurrer was sustained, without leave to amend due to AA’s failure to fully comply with the tort claim presentation requirements. AA’s action later settled for $40,000, in exchange for not filing an appeal. The passenger’s PI action was settled for a nominal amount.
