Mr. Rosen is a Senior Partner in the Los Angeles Office. For over 45 years, his practice has covered a wide variety of business transaction generated litigation for corporate and private clients, jury and non-jury, in the federal and state courts. He has also tried over a hundred cases in almost every type of civil litigation matter and is frequently asked to provide insight and advice on various matters that arise throughout the firm. Currently, he handles disputes arising out of trademark, copyright and patent infringement, contract disputes, real estate and securities transactions, fraud, misappropriation of trade secrets, RICO, statutory and common law unfair competition (Business & Professions Code § 17200), restraint of trade in general and antitrust in particular, interference and defamation. He is also very experienced in representing clients in class actions and has recently handled cases for clients such as insurance company stockholders, independent retail druggists and real estate development companies.
Mr. Rosen's extensive trial and litigation experience includes writing briefs which resulted in establishing that change of venue under 28 U.S.C. § 1404(a) does not oust application of the substantive law or the transferor forum (Barrack v. Van Dusen); and admiralty has jurisdiction over cases arising out of the crash of an airplane with one marine league of the land (Weinstein v. Eastern Airlines).
Some of his representative experience includes: defending producers of motion pictures in terms and conditions under which a motion picture would be distributed; representing shareholders in class action and securities fraud cases; defending against claims for interference and intentional infliction of emotional distress against a major real estate developer; successful defense of an individual against securities and common law fraud claims and SEC proceedings; defending land-use approvals obtained by the developer of a large tract, against claims of violation of CEQA and General Plan consistency requirements; successful defense of a pension fund against an action for breach of contract and specific performance of a $40 million loan commitment regarding the meaning and effect of the "prohibited transaction" provision in ERISA.
Recently, Mr. Rosen obtained a favorable settlement in his defense against claims for interference and intentional infliction of emotional distress on behalf of a major real estate developer in a multi-million dollar case, and he also defended a pension fund in a multi-million dollar ERISA matter against an action for breach of contract and specific performance of a loan commitment. He was also instrumental in obtaining a defense verdict for a client, a multi-level direct marketing company, against a former employee's claims of breach of contract, fraud, interference and constructive termination, arising from the company's termination of the plaintiff's downline.
Mr. Rosen also handles numerous intellectual property cases including representing a major manufacturer in a suit brought by servicers of electronic appliances claiming California antitrust, unfair business practices and unfair competition status. He was involved in a copyright infringement and breach of License Agreement case involving a global technology leader's operating system and user interface.
Mr. Rosen is an active member of the International Trademark Association and the Consumer Trial Lawyer Association. He also writes extensively and has authored the following publications: "A Review of California's Regulation of Political Parties," Ripon Society of Southern California, "The Impact of Proposition 2 on the California Usury Law," Los Angeles Daily Journal, and "RICO Claims by Celebrities Against the Tabloid Media for Publication of Purloined Material," American Journal of Trial Advocacy."
Mr. Rosen obtained his B.A. from the Wharton School of Finance and Commerce at the University of Pennsylvania in 1957 and his J.D. from Harvard University Law School in 1960. He is a member of the American Bar Association and is admitted to practice in California, Pennsylvania, the Central, Southern, Eastern and Northern Districts of California and the Eastern District of Pennsylvania of the United States District Courts, the Third and Ninth Circuits of the United States Court of Appeals, The United States Supreme Court and the United States Tax Court.
