Congratulations to Skip MartinJules Zeman and Sarah Seo  whose motion for summary judgment was granted in the case of Ted Munn et al vs. Flowserve US, Inc., on the first day of trial.  This case involved a claim for asbestos exposure brought by plaintiff who served aboard ship in the US Navy from 1959 to 1963.  This was one of the first successful applications of the Sophisticated User Doctrine as set forth in Johnson vs. Superior Court, a California Supreme Court decision handed down on April 3, 2008.  The summary judgment and argument involved a creative extension of the Sophisticated User Doctrine enunciated in Johnson and will have many ramifications throughout the asbestos litigation field if upheld on appeal.  The judge's tentative was to grant the motion but during oral argument he initially reversed himself and then after more argument by Skip and Jules, reversed himself again and granted the motion.
