Eugenie Gifford Baumann has published an article entitled "The Business Risk Exclusion" in the August, 2009 edition of Chemical Distributor. The article highlights several key exclusions found in most commercial general liability (CGL) insurance policies which limit coverage for faulty or defective work of the insured and which prevent the shifting of certain of the foreseeable costs of doing business from the insured to its insurance carrier. The article is designed to help chemical manufacturers and distributors--and their general counsel--navigate the fine distinction between such costs of doing business and the types of damage to the persons and property of third parties for which CGL coverage is intended. Ms. Baumann is Senior Counsel in the Los Angeles Office of Haight, Brown & Bonesteel and a member of the firm's Risk Management & Insurance Law Practice Group. Her practice focuses on insurance coverage and bad faith litigation with respect to both commercial and personal lines of insurance.
