Successful Defense of Concessions Company in Slip-and-Fall Trial

Congratulations to Michael Parme and Tyler Kaminsky for achieving a defense verdict in the jury trial of Wood v. Petco Park et al. 

The case arose from a slip and fall incident that occurred at Petco Park in San Diego, California.  In this case, Haight represented Delaware North Companies Sport Service, Inc., who provides concessions and catering service for Petco Park.  The plaintiff was injured while working for a temporary employment agency in a kitchen within the stadium.  He allegedly slipped on water while entering a walk-in refrigerator in July 2021.  Plaintiff alleged injuries involving his neck, lower back, left shoulder, left elbow, and left wrist.  The damages sought included substantial past medical bills for surgery to left shoulder and repeated steroid injections for pain management.  Plaintiff’s experts testified at trial that he suffered from chronic pain in multiple areas of his body, and would suffer from this pain indefinitely.  There was also testimony that future surgeries would be necessary to relieve his pain.  Plaintiff’s counsel sought recovery for orthopedic, pain management, and psychological treatment.  The evidence suggested the value of future treatment and pain and suffering would exceed $5 million.  The defense offered evidence disputing negligence and causation. After four days of trial, the jury returned a complete defense verdict, finding that the defendant was not the substantial factor in causing the plaintiff’s injuries.
