Anti-SLAPP Motion Granted Based on Litigation Privilege in Professional Liability Matter

Plaintiffs filed a professional responsibility action against our clients, a law firm and one of its attorneys, alleging defamation due to a letter the firm sent to a bank holding funds belonging to their client’s adversary in the underlying action during post-judgment collection activities. The court granted our anti-SLAPP motion to strike Plaintiffs’ claims based on the litigation privilege under Civil Code section 47, resulting in the dismissal of the case in its entirety and an award of costs and attorney fees for our clients.
