Defective Helmet in High School Football Injury

Haight represented Wasco Unified School District having been brought into the case by the excess carrier. Plaintiff was a high school football player who suffered a subdural hematoma during a game. He alleged his helmet, manufactured by Schutt Sports, was defective and that the school knew it was defective. The case was set for trial in January 2013. A Motion for Summary Judgment was pending at the time of mediation on the issue of express assumption of the risk. Future economic damages were estimated to be $6M. Demand at mediation was $4.5M. The case settled for $900,000.
