Excess Insurer Exonerated from $110M Case Alleging Violation of Due Process Against the County of Sacramento

Haight was asked by the County of Sacramento’s excess insurance carrier to join their counsel on this case which was originally tried in 2018. There was a jury finding of violation of due process by the County when it took the plaintiff’s gravel mine. Damages claimed were in excess of $110M. The verdict was against the County of Sacramento and the individuals who worked for the county. Punitive damages were assessed against the individuals. The 9th Circuit recently reversed in part and remanded in a decision not certified for publication. All individual defendants were exonerated. The judgment was upheld against the county as to liability but reversed and remanded as to damages.
