Successful Trial in a Complicated ADA Case Filed against a College District

In a complex ADA case filed by two blind plaintiffs against a California college district, the plaintiffs alleged violations of Title II of the ADA, the Rehabilitation Act and sought relief for the purported failure to provide accessible text books, course materials, research databases, websites and software. Plaintiffs’ pre-trial demand was $732,140. Both plaintiffs also sought emotional distress damages. The jury awarded $40,000 to one plaintiff while the other plaintiff received no damage award. The jury found in favor of our college district client on three of four discrimination claims.
