Haight Obtains Summary Judgment in Bad Faith Case Claiming Over $2 million in Damages

Haight attorneys obtained summary judgment for an insurer client in the U.S. District Court for the Eastern District of California in a hotly contested bad faith lawsuit where the policyholder claimed over $2 million in contract damages, plus attorney’s fees and extracontractual damages for bad faith. The policyholder sued the client alleging that the insurer had wrongfully denied a defense and indemnity for an employee’s wrongful termination lawsuit that had blossomed into a class action for wage and hour violations. On cross-motions for summary judgment the District Court denied the policyholder’s motion and granted client’s motion, ordering the entry of summary judgment for the client.
