Lawrence Zucker, Michael Parme and Beth Obra-White present, “Tried, True and Trends: Fundamentals of Risk Transfer” during Lockton Law Day in Denver, Colorado on February 13, 2020

This presentation explores a hypothetical loss to provide an overview of fundamental objectives and strategies for risk transfer in the context of employee and third-party claims. Then it uses the hypothetical loss to identify and illustrate the application of significant developments and trends concerning defense and indemnity obligations. These trends include the augmented scope of the duty to defend with respect to additional insured obligations; emphasis on strong contractual indemnity; the impact of recent changes in law regarding the utilization of independent contractors; and strategies for developing an approach to risk transfer that is both comprehensive and integrated.
