Haight’s motion to dismiss plaintiff’s second amended complaint was granted on September 13, 2017. Plaintiff filed a third amended complaint months after the deadline imposed by the court. Other than two additional sentences, the pleading was identical to the plaintiff’s second amended complaint. The Court found that the third amended complaint was not only deficient, but disregarded the court’s prior order and resulted in a waste of valuable judicial resources.
